The
Leader of The Revolution Now, Omoyele Sowore may not come to court today,
because the matter before the court is the hearing of his bail application
which he filed on 9th August challenging his detention by the DSS.
Sowore's
lawyer Falana and his team are already in court waiting for the arrival of the
judge.
The
Judge, Taiwo Taiwo stands down proceedings until 11 O'clock to accommodate more
of Sowore's counsel's who are on their way after an appeal by Femi Falana.
Falana
submits finally that the applicant lacks the competence to ask for the
detention of Sowore on the basis of national security. The facts must be before
the court.
He
said, “by virtue of Section 40 of the terrorism prevention act, the SSS is not
one of the bodies empowered to detain anybody”.
Falana
told the court that since the detention order has expired and application for
renewal has been withdrawn, the court should make a consequential order and
release Sowore.
He
also said; "If the court wants him and I will produce him (Sowore)."
